By accessing or playing Fatty Bird (“the Game”, “we”, “our”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Game.

You must be at least 13 years old to create an account or play the Game. By using the Game, you represent that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.

• You may sign in using your Google or X (Twitter) account. You are responsible for keeping your session secure. Do not share your account with others.
• You may choose a username after sign-up. Usernames must not impersonate other people, contain hate speech, or violate any applicable law.
• We reserve the right to suspend or terminate accounts that violate these Terms, without notice.

You agree not to:

• Cheat, exploit bugs, use bots, or use any automated tool to inflate your score or gain an unfair advantage.
• Attempt to reverse-engineer, decompile, or tamper with the Game, its server validation logic, or WebSocket protocol.
• Transmit malware, conduct denial-of-service attacks, or otherwise attempt to disrupt the Game’s infrastructure.
• Harvest data from the leaderboard or any other part of the Game without our express written permission.
• Use the Game in a manner that violates any applicable local, national, or international law.

Scores are validated server-side. We reserve the right to remove scores that we determine, in our sole discretion, to have been achieved through cheating or exploitation. Leaderboard positions are not a guaranteed feature and may be modified or removed at any time.

All content in the Game — including artwork, animations, sound, code, and the Fatty Bird name and logo — is owned by us or our licensors and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Game without our prior written consent.

You retain ownership of any username you create. By choosing a username, you grant us a non-exclusive, royalty-free licence to display it within the Game and on the leaderboard.

The Game is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Game will be uninterrupted, error-free, or free of viruses or other harmful components. We may modify, suspend, or discontinue the Game (or any part of it) at any time without notice or liability.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Game — including but not limited to loss of data, lost scores, or lost profits — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim (which, for a free game, is zero).

The Game uses third-party OAuth providers (Google, X). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of those third parties.

We may update these Terms at any time. The “Last updated” date above will reflect changes. Your continued use of the Game after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Game.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
